Rubbish Clearance Kennington Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Clearance Kennington provides rubbish removal, waste collection, and related clearance services. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business, or organisation requesting the services of Rubbish Clearance Kennington.
Services means any rubbish clearance, waste collection, removal, loading, transportation, and disposal or recycling services provided by Rubbish Clearance Kennington.
Site means the premises, address, or location where the Services are to be carried out.
Waste means the items, materials, and refuse to be removed from the Site as part of the Services.
Agreement means the contract between Rubbish Clearance Kennington and the Customer, comprising these Terms and Conditions and the booking confirmation.
2. Scope of Services
Rubbish Clearance Kennington provides rubbish clearance and waste collection services for domestic, commercial, and other properties within its designated service areas. The Services can include the loading, removal, and transportation of general household waste, garden waste, office rubbish, and certain types of bulky items.
The exact scope of the Services for each booking will be agreed with the Customer at the time of booking, based on the description of the Waste provided by the Customer. Any items not disclosed or significantly different from the description may be subject to additional charges or refusal of collection.
Rubbish Clearance Kennington reserves the right to decline any job that, in its reasonable opinion, is unsafe, unlawful, or beyond its operational capabilities.
3. Booking Process
3.1 Bookings may be made by telephone or by any other method offered by Rubbish Clearance Kennington from time to time.
3.2 When making a booking, the Customer must provide accurate information, including but not limited to the Site address, access details, description and approximate volume or weight of the Waste, and any relevant parking or loading restrictions.
3.3 Rubbish Clearance Kennington may provide a provisional quote based on the Customer's description of the Waste. This quote is subject to confirmation on arrival at the Site, once the Waste has been inspected by the collection team.
3.4 A booking is only confirmed when Rubbish Clearance Kennington issues a booking confirmation, verbally or in writing, which may specify the date, approximate time window, and estimated price.
3.5 Time slots are provided as estimates only. While reasonable efforts will be made to attend within the agreed time window, Rubbish Clearance Kennington cannot guarantee exact arrival times and accepts no liability for delays outside its reasonable control, including traffic or access issues.
4. Access and Parking
4.1 The Customer is responsible for ensuring that there is suitable and safe access to the Site for the collection team and vehicle.
4.2 Any parking charges, permits, congestion charges, or similar costs required to complete the Services are the responsibility of the Customer and may be added to the final invoice.
4.3 If the collection team is unable to access the Site due to incorrect information, locked gates, unsafe conditions, or other access problems, Rubbish Clearance Kennington may charge a wasted journey fee to cover reasonable costs.
5. Customer Obligations
5.1 The Customer warrants that they have authority to allow Rubbish Clearance Kennington to access the Site and remove the Waste.
5.2 The Customer must ensure that, where possible, Waste is ready for collection and clearly separated from items that are not to be removed. If the collection team is required to sort or move items extensively, additional labour charges may apply.
5.3 The Customer must inform Rubbish Clearance Kennington in advance of any hazardous, sharp, heavy, or awkward items that may require special handling.
5.4 The Customer is responsible for ensuring that the Waste presented is suitable for collection under these Terms and complies with relevant waste regulations.
6. Waste Types and Regulations
6.1 Rubbish Clearance Kennington operates in accordance with applicable UK waste management legislation and regulations, including the duty of care for waste handling and disposal.
6.2 Certain types of Waste cannot be collected, including but not limited to asbestos, clinical or medical waste, pressurised containers, explosives, radioactive materials, and other hazardous substances, unless otherwise explicitly agreed and legally permitted.
6.3 Electrical items, fridges, freezers, tyres, mattresses, and other restricted or regulated items may be subject to additional charges to cover specialist processing and recycling requirements.
6.4 Rubbish Clearance Kennington will, where possible, seek to recycle or recover materials and minimise landfill disposal, in line with good environmental practice. However, no guarantee is given as to the proportion of Waste that will be recycled.
6.5 Once the Waste has been loaded onto the collection vehicle, it becomes the responsibility of Rubbish Clearance Kennington and will be transported to an authorised waste transfer station, recycling facility, or disposal site.
7. Pricing and Quotations
7.1 Prices are generally based on the volume, weight, and type of Waste, as well as the time and labour required to perform the Services and any disposal fees or taxes.
7.2 Any prices given before inspection of the Waste are estimates only. The final price will be confirmed on Site before any Waste is loaded. If the Customer does not agree to the final price, the collection team will leave without performing the Services and no charges will apply, save for any agreed call-out fee.
7.3 Rubbish Clearance Kennington reserves the right to adjust its prices at any time. However, once a booking has been confirmed, the Customer will be charged according to the price agreed at the time of booking, subject to any variation arising from inaccurate descriptions of the Waste.
8. Payment Terms
8.1 Unless otherwise agreed, payment is due in full upon completion of the Services on the day of collection.
8.2 Accepted payment methods may include cash, debit or credit card, or bank transfer, as advised at the time of booking.
8.3 For business Customers or account holders, alternative payment terms may be agreed in writing. In such cases, invoices are payable within the agreed period. Late payments may incur interest and reasonable recovery costs.
8.4 All prices quoted are exclusive of any applicable taxes or charges that may be imposed by law, which will be added to the invoice where relevant.
9. Cancellations and Amendments
9.1 The Customer may cancel or reschedule a booking by providing reasonable notice to Rubbish Clearance Kennington.
9.2 If a booking is cancelled by the Customer less than 24 hours before the scheduled arrival time, Rubbish Clearance Kennington reserves the right to charge a cancellation fee to cover administrative and allocation costs.
9.3 If the collection team attends the Site and is unable to complete the Services due to reasons within the Customer's control, including lack of access or refusal of the agreed price after inspection, a wasted journey or call-out fee may be charged.
9.4 Rubbish Clearance Kennington may cancel or amend a booking if it is unable to provide the Services due to circumstances beyond its reasonable control, including vehicle breakdown, severe weather, illness, or safety issues. In such cases, any pre-paid amounts for unperformed Services will be refunded or the booking will be rescheduled by mutual agreement.
10. Liability and Insurance
10.1 Rubbish Clearance Kennington will exercise reasonable care and skill in providing the Services and will carry appropriate insurance for its operations.
10.2 The Customer is responsible for pointing out any fragile areas, valuable items, or parts of the Site that require special care. Rubbish Clearance Kennington is not liable for damage to property that arises from pre-existing defects, structural weakness, or circumstances beyond its control.
10.3 Except in respect of death or personal injury resulting from negligence, Rubbish Clearance Kennington's total liability to the Customer for loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific Services giving rise to the claim.
10.4 Rubbish Clearance Kennington is not liable for any indirect or consequential loss, including loss of profit, business interruption, or loss of opportunity, arising from the performance or non-performance of the Services.
10.5 The Customer shall indemnify Rubbish Clearance Kennington against any claims, liabilities, costs, or expenses arising from the Customer's breach of these Terms and Conditions or from the presence of hazardous or unlawful items within the Waste that were not disclosed in advance.
11. Complaints and Disputes
11.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with Rubbish Clearance Kennington as soon as reasonably possible so that it can be investigated and resolved.
11.2 Rubbish Clearance Kennington will aim to respond to complaints promptly and will work with the Customer to reach a fair resolution.
11.3 Nothing in this section affects the Customer's statutory rights under UK consumer law where applicable.
12. Data Protection and Privacy
12.1 Rubbish Clearance Kennington may collect and process personal data about Customers, such as contact details and address information, for the purpose of managing bookings, performing the Services, and handling payments and enquiries.
12.2 Personal data will be handled in accordance with applicable UK data protection laws. Customer information will be kept secure and will not be shared with third parties except where necessary to deliver the Services, process payments, or comply with legal obligations.
13. Health and Safety
13.1 Rubbish Clearance Kennington will carry out the Services with regard to the health and safety of its staff, the Customer, and the public.
13.2 If, in the reasonable opinion of the collection team, conditions at the Site are unsafe or present an unacceptable risk, Rubbish Clearance Kennington may suspend or refuse to carry out all or part of the Services. In such cases, an alternative arrangement may be agreed where possible.
14. Variation of Terms
14.1 Rubbish Clearance Kennington reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking.
14.2 Any variations to these Terms and Conditions requested by the Customer must be agreed in writing by Rubbish Clearance Kennington to be valid.
15. Severability
15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions and any Agreement arising from them shall be governed by and construed in accordance with the laws of England and Wales.
16.2 Any disputes arising out of or in connection with the Services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By booking a collection or clearance with Rubbish Clearance Kennington, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
